I am a July filer who has been working with his company for 5 years on H1. I have an offer to switch jobs and I am contemplating using EAD (I renewed it in 08,just never used it).
The new employer has verified my status using e-Verify. What surprised me is that , as soon as the verification was done, my existing employer called me and started asking me if I was planning to use the EAD and if they can do anything to alleviate my concerns about my compensation etc.
There is not way my current employer would know about my intentions since I maintained the confidentiality.
Does anyone know if e-Verify informs the current employer somehow? Do they receive a call from USCIS for any verification? Could this be a matter of concern?.

Kudos to my colleague Elissa Taub who pointed out something rather interesting that none of the supporters of the Arizona law have told Arizonans. Under federal immigration law, a removal proceeding is a civil proceeding and one is not entitled to a public defender or any assistance in paying for help from an immigration lawyer. However, the new Arizona law makes it a state crime to be illegally present in the state. Hello,
I filed 485 and also obtained EAD and AP. My wife has her own H1b through her employer, but used the AP from my 485 application once to enter the U.S., so right now her I94 shows an �AOS� status without an expiration date. Now her employer just filed H1b extension for her and the case is still pending.
My question is:
1) Can she travel internationally while her H1b extension case is pending and come back using AP? I was told this could void her H1b extension application according to the �last action rule�, is that true?
2) If 1) will be a problem, could it help if she stays aboard until her H1b extension gets approved and have the document mailed to her before she comes back?

I would like to invite my brother to US for a 2 month road trip I am planning in April.
I finished my employment in Jan and currently on 6 months B2 visa. I got my NZ residency approved and I will be leaving US in June at the end of road trip. I have been living in US for past 10 years (3 years on F1 and 6.5 years on H1B). I am 32 unmarried/male/Indian from Hyderabad.
My brother is 33 and is married with a 3 year old daughter. He manages my dads businesses (rental properties, finance, farm etc.). I am pretty sure he has some properties on his name.
I would like to know what are his chances of getting visa approved.
What do I need to provide him as support and what does he need to provide as support documentation ?? What does US consulate look for support typically and to what extent ?
I would really appreciate if anyone can give some advice especially someone who were successfully able to get a US visitor visa to their brother.

My I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?

Need your input in a scenario of a friend of mine. My friend's wife is on H1 for the past 4 months and wants to transfer to an H4 visa under her husband. The wife's employer has not paid her any salary nor has he got her any project for the past 4-5 months, hence they are forced to make this decision. The h1 my friend's wife is only H1 approval papers and it is not stamped on her passport. The wife's employer is not willing to give her any papers of release or letter of leave without pay from her employment.
She needs to desperatly change her status to H4.....Suggestions needed??

1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.
It will be counted in the quota

Well, if you have a job offer for which you qualify and all relevant supporting documents, I dont see why you wont get the approval.

As long as your company is generating Paystubs you are not outofstatus. but if there is an audit and if INS finds that you have not paid then its will be an problem.

I am nearing the five years on my H1B. My company (A) had it extended with my I-i40 approval. I want to know at this point is it okay to transfer h1B visa to another company (B)? I was told i can only get 9 month extensions with the transfer is that true? Also what if my company (A) cancels my GC process after transferring to company (B), do i have to go through the entire GC process again once I transfer to company (B)? I was told i only have to re apply the I-140 with the priority date given on the previous I-140?

My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!
I am so frustrated that I feel like going back to home country now.
