Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?

I am on 7th year of H1B with approved 140. 485 not filed yet.
My company is starting layoff and I am afraid I will be hit. If I switch to H4 after being laid off and found a new employer in future, is that possible to switch back to H1B without having to leave the country for a full year?
My current H1B was a three year extension based on approved 140, but I don't know if I will lose the benefit of AC21 and cannot change back to H1B once I switch to H4 since my 6 years have been used up already.

We are family of four and have the following status
Self - Adjustment of Status (AOS - 485 filed in July'07), AP, EAD and a valid H1 (renewed recently)
Spouse - AOS 485 (filed in July'07), AP, EAD, H4 expired end of April 2010
Son 14 yrs. old - AOS 485 (filed in July'07), AP, H4 expired end of April 2010
Daughter - 11 yrs old - AOS 485 (filed in July'07), AP, H4 expired end of April 2010

Please help me...I do not have much knowledge about GC process. I am working on H1B visa from last 3 years with my current employer and they are ready to apply for GC but, I know that for GC in the same position I cannot use the experience gained during past 3 years. But if I apply for GC for the next level (as GC is for future employment) with the current experience and keep working in my current role until my GC is approved, do you guys see any problem with that? GC approval will easily take 4-5 years and during this time I can keep working in my current position and once GC is approved I can switch to the next level which is kind of promotion.

Category classification of EB2 or EB3 is done when filing I-140. Labor does not have any such classification. It all depends on the job requirement that decides EB2/EB3 at I-140 while filing.

Hi,
My sister is a citizen and she applied GC for my parents who are in India.She applied for I-130 in April and it was approved in 2 months.She now has to fill the form I-864 and is in the process of doing so.Meanwhile my parents would like to visit USA.They'll be coming in December and be staying for 6 mos.They have a 10 yr visa and visited us back in 2004.
My question is it ok for them to visit USA?I read that they might be denied entry becasue of their approved I-130.We do not want to apply AOS here and they will return in June 09.

I applied for the I-140 and I-485 at the same time last October 9th 2009. I was requested an RFE in February of 2010 which they received back in March before the deadline. The RFE was looking for some basic info. I am still awaiting a response to the RFE or approval of the I-140. My job is currently going through tough times and there are rumors I will be laid of on April 30th. My question is that after April 9th(180 days after i filled I-140 and I-485) can i move jobs to a similar role before my I-140 is approved and if so what do i need to do.

The New York Times today reports on a surgery that is heroic in scope. Japanese-born Tomoaki Kato, a surgeon at New York Presbyterian Hospital/Columbia led a 43-hour operation to remove a massive tumor(the size of a football) that had engulfed the liver and other vital organs of a 59 year old man who had been told the tumor was inoperable. Hi,
My H1 was denied the last cycle. The denial decision was posted on Nov 24th. My application was in RFE state for quite some time, hence the delay. The question that I have is, as the denial came very late, will I be able to apply for an H1B this year. We generally file all our documents on 3.31, I am wondering if I would not be eligible this year because 3.31 is not 6 months from 11.24. There is an rule that I cannot apply if there has been a denial in the recent 6 months. Please let me know if that is the case. Will I be ineligible for this year (3.2010).
I am currently in my 4th year on a L1.

I received the excellent news today that the Memphis Youth Symphony Program has landed Bulgarian-born Stilian Kirov as it's new Music Director and Conductor. And since one of my children performs with the MSYP, the news is even better. Kirov is a graduate of the Julliard School of Music and has conducted major orchestras across Europe and the United States. Stilian is also an accomplished pianist. In 2001, he was awarded a gold medal in Paris' Claude Kahn International Piano Competition. We look forward to Maestro Kirov coming down Memphis way.
